Terms of service

OVERVIEW

This document contains the Terms of service that apply to all users of the site. The first part of the document describes the terms that are specific to the products and Services of our brand (e.g., related to specific products and Services offered by Akela Taka's Fursuits & Cosplay), while the second part describes general services related to shopping with us. Please read both parts carefully before accessing or using our website.

 

MAKING PRODUCTS BY ORDER

Please do be aware that most of our products (exluding digital products and Services) are made by order. The standard waiting time should be no longer than two weeks (14 days), however, we reserve the right to delay the processing of your order at any time. Sometimes, we may be short on supplies (e.g., the materials we use may be unavailable for a certain period of time) or we may get caught in “life events” (illness, family reasons, natural disasters, etc.). In such a case, we will allways contact you using the contact e-mail address that you have provided and tell you the estimated shipping time, and you have the right to cancel the order if you feel the estimated time is not acceptable.

CUSTOMIZATION OF  PRODUCTS

Some of our products can be customized per request. We offer silicone parts that can be dyed any color you want, some can be even casted in multiple colors. Resin parts are not offered dyed by default, but you can always contact us and ask whether it is available for a certain part to be dyed or colored certain way, and we will happily discuss all available options. Similarly, 3D printed parts are usually offered in certain color(s), but can be printed in a different color by request.

When you request color customization, you are required to provide us with a color reference, either a digital picture file containing the desired color or a hex code (the six-character code starting with # that refers to the RGB color spectrum). We will then do our best to match the product color with the provided reference. However, please be aware that we match colors by hand, and because every monitor is different and each person’s vision varies slightly, the color may not match the provided reference perfectly. If we are unsure, we will contact you and ask for your approval on the finished color, providing you with a photo. If you are really serious about the match, you can always send us a physical sample of the color.

Also please be aware that customized items are non-returnable and non-refundable (unless there is a defect or error that is clearly our fault).

USING OUR PRODUCTS IN YOUR PROJECTS

If you use our parts to make a commissioned costume or a premade for sale, it is ok with us. Just please do give us a credit! We will be also really happy if you can link to us, either to our website at www.akelataka.com, or by using our social handle @akelatakawolf.

REPRODUCING OUR WORK

The reproduction of our work, or any part of it, is strictly prohibited. Please do not make molds of our parts, scan them to create 3D-printed copies, or share our digital files online. Our specific style is well-known within the community, and such behavior will be quickly reported to us. If we detect such actions, we will not hesitate to take legal action to prevent theft.

WORKING WITH OUR PRODUCTS

When using our products, you are responsible for your own safety and the safety of others. Please wear safety gloves and glasses when cutting or using a Dremel tool on our products, and stay safe when using a hot glue gun. We are not responsible for any injuries you may cause to yourself while working with our products.

SHIPPING ORDERS

We are located in the Czech Republic (European Union), but we ship worldwide. As long as your country allows it, we will send the shipment with full insurance and tracking, depending on your destination. If you live outside the European Union, please research and understand the customs/import fees or taxes involved with receiving an item from the EU and plan accordingly. We will NOT list items for outside the EU as gifts or mark them underpriced. As much as we would love to help you avoid the stress linked to the taxing process when receiving a shipment from abroad, it is ILLEGAL, and as such, we cannot help you.

We will pack the order to survive possible water damage and rough handling. However, we are not responsible for any damage your order might receive in the mail. If the items never arrive, we will contact the shipping company and request a refund of the insurance cost. You will then receive your money back (or replacement of the lost item, depending on your preference), but please be patient as this can take any amount of time (usually about three months). Please do not rush the process. Also, please keep in mind that shipping the order overseas may take a month or two, especially in busy months such as December.

GENERAL TOS RELATED TO SHOPPING WITH US

This website is operated by Akela Taka's Fursuits & Cosplay. Throughout the site, the terms “we”, “us” and “our” refer to Akela Taka's Fursuits & Cosplay. Akela Taka's Fursuits & Cosplay offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse Service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. However, we will always try our best to solve any problém that may arise with any product or Service, so do not hesitate contacting us.

SECTION 5 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
